By accessing our website or engaging our advisory services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not access the website or use our services.
1. Nature of Advisory Services
Next Cascade Core is an independent technical analytics consultancy specializing in mobile application telemetry audits, subscriber cohort modeling, StoreKit and Google Play receipt reconciliation, and customer lifetime value (LTV) measurement.
Our services are delivered as professional consulting, architectural reviews, and statistical models. We do not operate an automated SaaS platform, nor do we provide automated financial or investment advice. Any projections, models, or retention estimates are based on historical data provided by the client and statistical modeling techniques.
2. Client Engagement & Statements of Work
Specific advisory engagements (such as our Comprehensive App LTV Tracking Audit or Cohort Retention Modeling) are governed by individual Statements of Work (SOW) or written service agreements executed between Next Cascade Core and the client. In the event of any conflict between these Terms and an executed SOW, the terms of the specific SOW shall prevail.
Clients are responsible for providing accurate, non-corrupted data extracts, database read access, or anonymized event logs necessary for the execution of agreed audit milestones.
3. Intellectual Property Rights
- Our Proprietary Materials: All content on this website, including diagnostic frameworks, written guides, origami-inspired visual styling, graphics, logos, and custom code templates, is the exclusive intellectual property of Next Cascade Core and is protected by copyright and intellectual property laws.
- Client Data & Custom Models: Clients retain full ownership of their raw telemetry data, proprietary application code, and confidential subscriber databases. Models and custom SQL scripts delivered as part of a paid consulting SOW become the property of the client upon receipt of full payment.
4. Confidentiality & Non-Disclosure
We maintain strict confidentiality regarding all proprietary information, telemetry schemas, revenue figures, and business metrics shared with us by prospective and active clients. We readily execute mutual non-disclosure agreements (NDAs) prior to accessing any client code repository, database cluster, or store developer portal.
5. Limitation of Liability
To the maximum extent permitted by applicable law in Thailand:
- Next Cascade Core, its partners, consultants, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or goodwill arising out of or related to our audit findings, code recommendations, or marketing decisions made based on our models.
- Our total aggregate liability arising from any consulting engagement shall not exceed the total fees actually paid to Next Cascade Core by the client under the applicable Statement of Work during the three (3) months preceding the claim.
6. Governing Law & Dispute Resolution
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Kingdom of Thailand (TH), without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms or our services shall be submitted to the exclusive jurisdiction of the competent courts of Thailand.
